From what I've read, that's just the maximum sentence that the crime carries, the Crown is not even asking for it.
Fish is right. There's no way in hell a trial judge would impose that sort of sentence in this case. If he/she did, an appellate court would intervene. In these circumstances I'm not sure any custodial sentence would be appropriate.
The Crown seems to think 2-years would be the upper limit in these circumstances but she's only seeking a few months served in house arrest. His lawyer says a fine would be appropriate.I wouldn't want to be the Quebec judge who sent la Fleur for an extended stay in the Greybar Hotel.
